How long Sean “Diddy” Combs might be sentenced will depend on Judge Arun Subramanian, following a jury’s conviction on two out of five charges. For the two prostitution convictions, he faces a maximum penalty of 10 years for each charge. However, this doesn’t guarantee he will serve 20 years, according to Jennifer Beidel, a criminal defense attorney at Dykema Gossett and a former federal prosecutor in New York.
Beidel explains to the BBC that typically, if a defendant is convicted of two similar charges, the judge will often impose concurrent sentences unless there are aggravating circumstances. The judge has considerable discretion, which will likely consider Combs’ criminal history, a presentencing report from probation officers, and his behavior while incarcerated.
As for potential sentencing, Beidel speculates it could be around two years, assuming Combs has no significant criminal record. He has been in custody since September 16, 2024, and this time will count against his final sentence. If Combs displays good behavior in jail, he may receive “good time credit,” which could reduce his sentence by an additional 15%.
Ultimately, Beidel notes that it’s impossible to predict an exact sentence at this stage, as the final decision rests with the judge.
